Cabinet Approves Updated Seven Mile Public Beach Park Vendor Policy Introducing Review Process

The Ministry of District Administration and Lands (MDAL) in conjunction with the Public Lands Commission (PLC), are pleased to announce that the Cabinet has approved amendments to the Seven Mile Public Beach Park Vendor Policy. These amendments include the introduction of a review process, providing an appeal mechanism for all vendor applicants.

The updated Seven Mile Public Beach Park Vendor Policy is now available on the PLC’s website. This revision aims to enhance transparency and fairness in the vendor permit application process and includes the following key provisions:

• Introduction of review (appeals) process: The new Review Process allows 2023 vendor applicants to request the reasons behind the decisions made on their permit applications and to seek a review of those decisions if desired.

• Timelines for review requests: Vendors have 10 business days to apply for a review or to request reasoning for the PLC’s decision. If reasoning is requested, vendors have an additional 7 business days to apply for the Review after receiving the reasoning.

• Application process: Vendors can submit their requests for review or reasoning by letter or email to the PLC Secretary at plc@gov.ky clearly stating their grounds for challenging the PLC’s decision.

• Review committee: Reviews will be conducted by a committee comprising a minimum of three Ex-Officio PLC members. The review process will be based on submitted documents only and will not involve in-person hearings. All decisions made by the Review Committee will be final.

Additionally, the policy emphasizes strict enforcement of regulations regarding unauthorised commercial activities on public lands:

• Immediate vacating for unauthorised vendors: Any vendor who did not apply for, and was not granted, a vendor permit for the Seven Mile Public Beach must vacate public land immediately. Failure to do so constitutes an offence under section 27 of the Public Lands Act (2024 Revision), which may result in a fine of up to CI$5,000 and/or up to 6 months imprisonment upon summary conviction.

• Continued operations during review: Vendors who applied for a vendor permit in 2023 and who now request a review within the designated timeline may continue trading on-site until determination of their review.

While vendors will be contacted directly with details of the review process, this announcement aims to inform the public of the PLC’s efforts to effectively regulate and protect the use of public beaches.
